SC Warns Against Using Criminal Laws to Gag Indian Press

In its 2025 jurisprudence, the Supreme Court strongly cautioned against the chilling effect of criminal prosecution on Indian journalists. The Court boldly reiterated that critical dissent against those in power cannot be equated with anti-national conduct. Strong criticism and political satire were officially recognized as legitimate modes of democratic participation.

Bharat Media Association sees this as a crucial validation of the press's democratic power, ensuring reporters can rigorously question public institutions without the constant fear of retaliatory state-sponsored criminal charges.
