Article 8 – Citizenship for Indians Living Abroad “Indian by origin. Citizen by choice.”

What is Article 8 All About?
Article 8 of the Indian Constitution offers citizenship rights to people of Indian origin who are living outside India, provided certain legal conditions are met.
It helps individuals who were not born in India, but whose parents or grandparents were, to become Indian citizens — even while residing in foreign countries.
What the Constitution Says (Official Text):
“A person who or either of whose parents or any of whose grandparents was born in India as defined in the Government of India Act, 1935, and who is ordinarily residing in any country outside India shall be deemed to be a citizen of India if he has been registered as a citizen by the diplomatic or consular representative of India in that country.”
What Does This Mean in Simple Terms?
If your father, mother, or grandparent was born in India before independence (as per the 1935 Act), and you are now living in another country,
👉 you can become an Indian citizen by registering at the Indian Embassy or Consulate in your country of residence.
Example 1:
Ravi, whose grandparents were born in India before 1947, lives in South Africa.
He applies at the Indian High Commission, provides the documents, and is granted Indian citizenship under Article 8.
Example 2:
Anita, born in Malaysia, has a father who was born in India in 1930.
She registers through the Indian Embassy in Kuala Lumpur and becomes an Indian citizen under this Article.
Key Conditions to Qualify Under Article 8:

You must apply for citizenship at the Indian diplomatic mission (embassy or consulate) in the country where you live.

You should not be an illegal migrant or have conflicting citizenship obligations elsewhere.
